Terms of Use — Osir
Version: 2.5 — October 7, 2026 Effective date: October 7, 2026 Canonical URL: https://foretalestudio.com/legal/osir/terms-of-use/en/
1. About These Terms
These Terms of Use ("Terms") govern your use of the Osir mobile application ("the App"), published by FORETALE STUDIO (FTS), a simplified joint-stock company (SASU) with a share capital of 1,000 EUR, registered with the Lyon Trade and Companies Register under SIREN 938 483 914, whose registered office is at 21 rue Maurice Flandin, 69003 Lyon, France ("the Publisher", "we", "us").
By downloading, installing, creating an account in, or using the App, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the App.
The App is distributed through the application stores of Apple Inc. and Google LLC. Their own terms of service also apply to your download and to any purchase you make. Where these Terms and a store's terms conflict on a matter the store controls (payment, refund, download), the store's terms prevail.
2. Who May Use the App
The App is intended for adults only. You must be at least 18 years old to create an account and use the App. The App asks for your age during onboarding and does not let you continue below 18. The Publisher does not knowingly provide the App to minors; if you believe a minor is using it, write to contact-us@foretalestudio.com. The App also asks you to attest that you are of age before accepting these Terms. The threshold is not only contractual: a restrictive eating programme is not suited to a growing body, and a minor's health belongs with a doctor, not an app.
You must also be legally capable of entering into a binding contract in your country of residence.
3. What Osir Is
Osir is a self-guided companion for structured eating programmes. Depending on the programme you choose and the features available on your device, the App can:
- build a weekly menu from the rules of the programme you selected, and the shopping list that goes with it;
- give you a checklist for the day and a way to close it;
- let you record your weight, your waist and, if you paste them from your own scale, body-composition values, and show their trend;
- help you find, compare and photograph products that fit the programme's nutritional targets, including reading a product label on your device's camera;
- offer short lessons that explain the programme's principles;
- keep an optional online account so you can find your data again on another device.
The App is a generic engine: every programme is a separate "pack" with its own rules, foods and phases. The Publisher may add, modify or withdraw packs over time (see §11).
4. What Osir Is Not
4.1 An information and planning tool, not medical follow-up
The App is an information and planning tool: it explains a programme, composes menus and shopping lists from that programme's rules, and lets you record your measurements. It is not a medical device, it makes no diagnosis, it neither treats nor monitors any disease, and it provides no medical, dietary or psychological follow-up. Nothing in it constitutes medical, dietary, nutritional, psychological or professional advice. It does not know your state of health: the menus, food lists, portions, targets, scores and lessons are generic, indicative, and not validated by any health authority; they are not adapted to your metabolism, your medical history or your treatments.
Consult a physician or a registered dietitian before starting, changing or stopping an eating programme, and follow their advice over anything the App says. A restrictive eating programme is followed with a doctor's agreement and under a doctor's supervision.
4.2 Not affiliated with any programme, centre or brand
The App is not affiliated with, endorsed by or approved by any weight-loss centre, medical practice, clinic, method or branded programme. The packs are original compilations by the Publisher based on published, general nutritional principles. Brand and product names that appear in the App are cited for identification only, without affiliation, and remain the property of their owners.
4.3 No guarantee of results
The App makes no therapeutic, curative or preventive claim (Regulation (EC) No 1924/2006). It does not promise any weight loss, body change or health outcome. Results vary with your body, your adherence, your medical situation and many other factors.
4.4 Nutritional data is indicative
Nutritional values shown in the App come from public databases, from product labels read by you or by the App's camera, and from your own entries. They are provided for guidance only, are not official labelling within the meaning of Regulation (EU) No 1169/2011, may be out of date or misread, and must be checked against the product's actual packaging. The App does not endorse, certify or guarantee any product.
5. Your Responsibilities
5.1 Your health
You are solely responsible for deciding to start, follow or stop a programme. Before you begin, the App asks you to tick the situations that concern you, then to give one of two answers: "none of the situations above concerns me", or "one situation concerns me and I have my doctor's written agreement". Your answer is recorded as you give it. Answer honestly: the App does not check your answers and cannot take into account what you do not tell it.
The situations the App asks you to declare, and why. A programme low in carbohydrates and calories changes blood sugar, potassium and hydration. If you take insulin or a sulfonylurea, it can cause hypoglycaemia; if you take an SGLT2 inhibitor, ketoacidosis, even with normal blood sugar; if you take a diuretic, lithium or a potassium-sensitive treatment, it can unbalance that treatment; if you take a vitamin K antagonist anticoagulant, the vitamin K in vegetables matters; if you take corticosteroids or immunosuppressants, your treatment and your diet must be reviewed together. It is not suitable during pregnancy or breastfeeding, under 18, in case of kidney, liver or heart disease, pancreatitis, porphyria or a heart rhythm disorder. In each of these situations, talk to your doctor before you start, and declare it in the App when it asks.
What the App does with your declaration. In most of these situations (pregnancy or breastfeeding; type 1 diabetes, or diabetes treated with insulin, a sulfonylurea or a gliflozin; kidney disease, at any stage; liver disease, pancreatitis or porphyria; heart disease, a recent heart attack or stroke, a heart rhythm disorder; a vitamin K antagonist anticoagulant; long-term corticosteroids or immunosuppressants), the App does not let you start; your doctor's agreement, if you declare it, is recorded and does not lift the block. With another diabetes treatment (or a doubt about the class of your treatment), a diuretic, lithium or a potassium-sensitive treatment, or over 65 or in frail health, it lets you start only if you declare your doctor's written agreement. Under 18, the App does not let you continue (section 2).
An eating disorder, current or past, is declared: the App then turns on safe mode, which hides streaks, scores and celebrations around weight. That mode is a restriction, and not care. If you are going through an episode right now, this programme is not made for you: talk to your doctor.
When to stop and consult. Dark urine for more than 48 hours despite proper hydration; dizziness when standing up; palpitations or chest pain; extreme fatigue beyond five days; vomiting; any new treatment started during the programme. In these cases, and more generally in case of malaise, persistent side effects or doubt, stop the programme and consult a doctor without delay.
5.2 Allergies, intolerances and products
The App may suggest foods or products to which you are allergic or intolerant. You must check every item against your own allergies, read the actual labels, and verify that a product suits you. Product formulations change without notice.
5.3 Your entries
Everything you add to the App (measurements, products, notes, preferences, photographs of products) is entered under your own responsibility. The Publisher does not review it.
5.4 Your account
You are responsible for the device and the e-mail address or Google account you attach to the App. Keep them secure; do not let anyone use your account. Give accurate information. Tell us at once if you suspect unauthorised access.
5.5 Acceptable use
You agree not to: use the App unlawfully or to harm yourself or others; reverse-engineer, decompile or extract the App, its packs, its food databases or its content, except as the law allows; overload, attack or probe the Publisher's servers; resell, rent or sublicense the App or its content; use automated tools to scrape it; or remove any notice of ownership.
6. Account and Online Features
6.1 The anonymous account
Once these Terms and the Privacy Policy are accepted, the App creates an anonymous account on the Publisher's servers ("the portal"), identified by an account identifier and by a random identifier of your installation, derived from no characteristic of your device. This account exists so that the App can later attach an e-mail address and restore your purchases. It contains no name and no health data.
6.2 Linking an identity
You may attach an e-mail address (verified by a one-time code) or a Google account. Linking is optional. Every feature of the App works without it, on your device alone.
6.3 Your health data stays on your device
Your health-related data (weight, waist, body composition, notes, declared medical situations, profile, food preferences, progression) stays on your device. Health synchronisation is not offered in this version of the App: no setting switches it on, and signing in to an account sends none of this data. If it is offered one day, it will be asked for separately from these Terms, after an explicit, separate consent that you can withdraw at any time. Details are in the Privacy Policy.
6.4 Availability
The online features (account, synchronisation, purchase validation) are provided on a best-effort basis. The Publisher may suspend them for maintenance, security or legal reasons, and does not guarantee uninterrupted availability. The App remains usable offline.
6.5 Suspension and termination by the Publisher
The Publisher may suspend or close an account, after notice where reasonably possible, if you breach these Terms, if the law requires it, if the account is used for fraud or abuse, or if the online service is discontinued. Data on your device is not affected by the closure of the online account.
7. Prices, Subscriptions and Purchases
7.1 Free tier and paid tiers
The App is offered under a freemium model: a set of features is free of charge, with no time limit; additional programmes and features are unlocked by a paid subscription ("Essential", "Assist"), and, for early users, by one-time purchases that the Publisher continues to honour.
During the launch period the Publisher may make every programme available free of charge. Such an offer is temporary, may be withdrawn, and creates no right to future free access.
7.2 How purchases work
All purchases are made through the application store of your device and are subject to its terms. The exact price, in your currency, is shown by the store before you confirm. The store collects the payment; the Publisher never receives your payment details.
7.3 Subscriptions renew automatically
A subscription is billed for the period you choose (monthly or yearly) and renews automatically for the same period, at the price shown in the store at renewal, unless you cancel at least 24 hours before the end of the current period. You manage and cancel your subscription in the subscription settings of your app-store account, not in the App. Cancelling stops the next renewal; the current period continues to its end and is not refunded pro rata.
If a free trial or an introductory price is offered, its length and the price that follows are shown before you subscribe; the subscription converts to the regular price at the end of the trial unless you cancel before.
The Publisher may change the price of a subscription; you will be informed in advance through the store, and the new price applies only from the next renewal after you have been notified, in accordance with the store's rules.
7.4 Restoring purchases
Your purchases are tied to your app-store account. You can restore them free of charge on any device signed in to the same store account ("Restore purchases" in the App), including after a reinstall.
7.5 Refunds and right of withdrawal
Refunds are handled by the store under its own policy and must be requested from it. If you are a consumer in the European Union, you have a 14-day right of withdrawal for a digital service; when you ask for immediate access to the paid content and expressly agree, in the store's purchase flow, that you lose your right of withdrawal once the content is delivered, that right no longer applies (Article L.221-28 of the French Consumer Code). Nothing in this section limits the rights the store grants you.
7.6 Continued access
A programme you have unlocked stays available to you for the period you paid for. The Publisher may update, replace or, exceptionally, withdraw a programme; if a programme you paid for is withdrawn without an equivalent replacement during a period you have already paid for, contact us for a remedy.
8. Intellectual Property
8.1 The App
The App, its code, its design, its mark, its illustrations, its lessons, its programme packs, its food and product databases and their arrangement, and its texts are the property of the Publisher or its licensors and are protected by the French Intellectual Property Code, the Berne Convention and Directive (EU) 2019/790. All rights not expressly granted are reserved.
8.2 Your licence
Subject to these Terms, the Publisher grants you a personal, non-exclusive, non-transferable, revocable licence to install and use the App on devices you own or control, for your own personal, non-commercial use.
8.3 Your content
Your entries remain yours. To operate the online features you have enabled, you grant the Publisher a licence to store, copy and transmit your content to the extent needed to provide the service to you, for as long as your account exists. The Publisher does not use your content for any other purpose.
8.4 Third-party data and brands
Nutritional data may come from Open Food Facts (Open Database License) and from Ciqual (ANSES, Etalab open licence). Product photographs from Open Food Facts are used under their CC BY-SA licence with attribution. Brand and product names are the property of their owners and are cited without affiliation. Open-source components are listed in the App under Settings → Legal → Licences.
9. What the Publisher Does, and What It Answers For
9.1 What the Publisher undertakes to do
The Publisher provides the App with care and diligence. It undertakes to:
- compose the programmes from published nutritional principles and from sources it cites in the lessons;
- take the nutritional values in its own data from public databases (the ANSES Ciqual table, Open Food Facts) or from product labels, and show their origin;
- correct, within a reasonable time, an error reported to it;
- show the contra-indications and the stop signals (§5.1) before a programme begins;
- maintain the online features with the means of a publisher of its size, without guaranteeing uninterrupted availability (§6.4).
These are obligations of means: the Publisher does not promise a result, it promises to act with competence and prudence.
9.2 What the Publisher does not undertake
The App is an information and planning tool (§4.1). The Publisher makes no diagnosis, neither treats nor monitors any disease, and provides no medical or dietary follow-up. It knows neither your state of health, nor your treatments, nor your medical history beyond what you declare; it does not check your entries and does not adapt the programme to your medical situation. The results of a programme depend on your body, your choices and your state of health: the Publisher promises no weight loss and no effect on your health. The nutritional values shown may be out of date or misread; the product's actual packaging prevails (§4.4).
9.3 What you answer for
You answer for the accuracy of your answers to the questions asked during onboarding (contra-indications, age), for the decision to start, continue or stop a programme, and for complying with the warnings displayed (§5). Where a damage is caused by an inaccurate answer to those questions or by a disregarded warning, that fault is taken into account as the law provides. You also answer, under the general law, for damage you cause the Publisher through unlawful use of the App (§5.5).
9.4 What the Publisher answers for
The Publisher is liable, under the general law, for damage caused by a breach of its obligations: for example a wrong value in its own data, a missing warning that the state of knowledge required, or a programme offered despite a contra-indication you had declared. Its liability for death or personal injury, for gross negligence or wilful misconduct, under the legal guarantee of conformity for digital content and services (Articles L.224-25-1 and following of the French Consumer Code) and under liability for defective products (Directive (EU) 2024/2853, as transposed) is neither limited nor excluded. These Terms contain no cap, no exclusion and no indemnity clause against a consumer: nothing in them deprives you of a right the law gives you as a consumer, and a clause that did so would be deemed unwritten (§14).
9.5 Legal guarantee of conformity
As a consumer, you benefit from the legal guarantee of conformity for digital content and services: the App must match its description (§3) and work as announced, and the updates needed to keep it in conformity are provided to you for as long as the service is owed. A defect is reported to contact-us@foretalestudio.com, describing what does not work. The Publisher remedies it within a reasonable time and free of charge; failing that, you may obtain a price reduction or the termination of the contract, under the conditions of the French Consumer Code. This guarantee is in addition to the rights your device's app store grants you (§7.5).
9.6 Professional users
If you use the App in the course of a professional activity, and only in that case, the Publisher's liability for damage other than personal injury is limited to the amount you paid it in the twelve months preceding the event giving rise to the claim, except for gross negligence or wilful misconduct. This limitation never applies to a consumer.
10. Privacy
The Publisher processes your personal data as described in the Privacy Policy. In short: your data lives on your device; an anonymous account exists on the portal; your health data is recorded on the device only with your explicit consent, asked during onboarding through a tick of its own, and it does not reach the portal (synchronisation is not offered in this version); the App keeps on the device a dated record of what it asked you and what you answered ("My declarations"); there is no advertising, no analytics sent to the Publisher and no tracker; if you agree, the App keeps a journal of how you use it on your device, which is not sent; you can export and delete everything, including your account, from the App, and correct everything that is not that record, a line of which is never changed but can be completed.
11. Changes
11.1 To the App
The Publisher may modify, update or discontinue the App or any feature or programme at any time. Where a change materially reduces what you have paid for, §7.6 applies.
11.2 To these Terms
The Publisher may update these Terms. The App will show you the new version and ask you to accept it before you continue; the version number and dates at the top of this document change accordingly. If you do not accept the new Terms, you may stop using the App and delete your account; your data stays yours.
12. Termination
You may stop using the App at any time. Uninstalling it deletes the data on your device; to delete your online account and its data as well, use Settings → Account → Delete my account before uninstalling, or write to us.
The Publisher may discontinue the App or its online services with reasonable notice. This does not affect data already on your device, which you can export at any time.
13. Governing Law, Mediation and Jurisdiction
These Terms are governed by French law.
If you are a consumer, you may, after writing to us and failing to obtain a satisfactory answer within one month, refer the dispute free of charge to a consumer mediator (Articles L.611-1 and following of the French Consumer Code). The mediator will be designated before the first paid offer; their details will appear here and in the Legal Notice.
Any dispute that is not resolved amicably falls under the jurisdiction of the competent French courts. If you are a consumer resident in another Member State of the European Union, you also benefit from the mandatory protective provisions of the law of your country of residence, and you may bring proceedings before the courts of that country.
14. Miscellaneous
If any provision of these Terms is found invalid, or unfair within the meaning of Article L.212-1 of the French Consumer Code, it is deemed unwritten and the remainder remains in force. The Publisher's failure to enforce a provision is not a waiver. You may not assign these Terms; the Publisher may assign them to a successor of its business with notice to you. The French version of these Terms prevails in case of discrepancy with a translation.
